Property management types and AI data licensing

Residential, HOA/community and commercial property managers: what each could license to AI buyers, what stays out, and how size rules apply.

Last updated 8 sources cited3 min read

Short answer: Often yes for operating records with personal and contractual data removed. Residential managers hold the most consumer data (screening reports and payment details stay out). HOA managers mostly license their own operating records, because association files often belong to the board. Commercial managers face more lease confidentiality. Mode asks for 50+ employees in this industry; micro1 asks for 30+.

Residential managers

Often yes, for operating records with tenant personal data removed: work orders, leasing workflows, owner reporting and vendor management. Screening reports and payment data stay out. Census counts 2,824 U.S. residential property managers with 30+ employees and 1,886 with 50+.

  • Maintenance requests and work orders, from request to completion.
  • Leasing inquiries, showings and renewals.
  • Owner statements and monthly reporting.
  • Rent ledgers, tenant screening reports and payment details (keep these out).

Tenant screening and credit reports are consumer reports under the Fair Credit Reporting Act. Keep health records, payment card data and children's data out of scope entirely: each has its own legal rules, and a buyer's de-identification doesn't change that.

HOA and community association managers

Carefully, and mostly the manager's own operating records. Many association records belong to the association, not the management company. Mode's published rules ask that the company owns the records it licenses (Mode).

Florida's HOA statute lists records that 'are not accessible to members or parcel owners', including privileged records, personnel records, and owners' Social Security, driver license and credit card numbers, email addresses and phone numbers (Fla. Stat. § 720.303). If the law shields them from members, they shouldn't go to a buyer.

  • The manager's own internal SOPs, training and vendor-management records.
  • Work-order and violation-process workflows with owner data removed.
  • Meeting-preparation and budgeting processes, with association consent.

Commercial managers

Possibly. Commercial managers have less consumer data than residential ones but more contract confidentiality. Census counts 1,119 U.S. nonresidential property managers with 30+ employees and 746 with 50+.

  • Lease abstracts, CAM reconciliations and tenant billing.
  • Work orders, vendor contracts and capital projects.
  • Owner and lender reporting.
  • Tenant financial statements (often confidential by lease).

Check confidentiality clauses in leases, management agreements and loan documents before scoping. A law-firm guide on data deals stresses confirming you have the right to license each data set (Frankfurt Kurnit).

Size and program fit

Mode lists 50+ employees for industries outside legal (10+) and accounting, medical and finance (15+) (Mode). micro1 asks for 30+ employees, mostly English data, and says it is prioritizing US companies (micro1).

Per Mode's site, Mode reviews the systems and dates in scope, years of history, record volume and quality, and ownership and access terms before making a fixed offer.

Frequently asked questions

Do tenants need to agree?

It depends on your leases, privacy notices and state law. Ask your attorney; the buyer's de-identification doesn't replace that review.

Can an HOA board approve licensing association records?

The board can speak for the association's records, subject to governing documents and state law. Get it in writing.

Are business tenants' contacts personal data?

Often yes under state privacy laws. California's CCPA business-to-business exemption expired at the end of 2022, according to the state Attorney General.
