Construction companies: safety records, government contracts and AI data

OSHA injury-log privacy, defense-contract information rules and owner contracts: what a contractor must check before licensing project records.

Last updated 2 sources cited1 min read

Short answer: Project records are licensable in principle, but injury logs, defense-contract information and owner-confidential documents need care. OSHA treats some injuries as 'privacy concern cases', and DFARS 252.204-7012 requires adequate security for covered defense information.

Injury and illness records

For privacy concern cases, employers 'may not enter the employee's name on the OSHA 300 Log' and enter 'privacy case' instead (29 CFR 1904.29). Keep injury records out of scope.

Government work

Defense contractors must provide 'adequate security' on covered contractor information systems, generally under NIST SP 800-171, and report cyber incidents within 72 hours (DFARS 252.204-7012). Don't include covered defense information.

Owner contracts

Owners, especially in healthcare, data-center and security-sensitive projects, often restrict drawings and site information. Check contracts project by project.
