Can a real estate brokerage sell its data to AI?
Headcount
Qualified real estate agents can be treated as non-employees for federal tax (26 U.S.C. § 3508), and Census counts only paid employees. Mode's 50+ applies to real estate; micro1 and Anthagen ask for 30+.
| Industry (U.S. firms, 2022) | All firms | 10+ staff | 15+ | 30+ | 50+ |
|---|---|---|---|---|---|
| Offices of real estate agents & brokers (NAICS 531210) | 150,892 | 3,343 | 1,851 | 897 | 442 |

Only about 900 U.S. brokerages report 30+ employees, and about 440 report 50+.
MLS content
One large MLS prohibits using MLS content to train open or public AI systems (ARMLS policy). Keep listing data out unless your MLS agreement allows it.
What's left

Do agents count toward headcount?
The programs don't publish a rule. Mode's FAQ bands use full-time US staff. Ask the buyer before you assume.
Is a brokerage with a property management division a better fit?
Often, because property management staff are usually employees and the work-order records are rich.
