Selling data after an acquisition: who owns it?
Short answer: Usually the acquirer, if the records transferred with the business, and the purchase agreement decides. Check the asset list, any transition services agreement, and privacy commitments made to customers and employees before anyone talks to a buyer.
Where to look
- The purchase agreement's asset and IP definitions.
- Data-room terms and confidentiality clauses.
- Customer contracts and privacy notices.
Buyers check ownership too
Mode lists ownership of the records among its requirements (Mode affiliate FAQ). AIData.Broker says the holder signs everything (AIData.Broker).
