Can a nonprofit sell its data to AI?

Whether nonprofits qualify for AI data programs, what donor and client data needs care, and how many U.S. organizations meet the size rules.

Short answer: Some can. Mode says companies and nonprofits can qualify, with 50+ employees for most sectors, and micro1 asks for 30+. Donor, member and client data needs care, and the tax treatment of license income is a question for your tax advisor. Census counts 15,574 civic, religious, grantmaking and professional organizations with 30+ employees.

Who qualifies

Mode lists 50+ employees for industries outside legal (10+) and accounting, medical and finance (15+) (Mode). micro1 asks for 30+ employees, mostly English data, and says it is prioritizing US companies (micro1).

Data that needs care

  • Donor records and giving history.
  • Client or beneficiary case files (often health or family data). Mode says health records, payment card data and children's data are excluded, and that its AI customer is contractually barred from trying to identify anyone in the data (Mode affiliate FAQ).
  • Member lists, which some organizations promise not to share.
  • Grant reports that funders may restrict.

Mission and trust

If your privacy policy promised donors or members something, keep that promise. The FTC warns that quietly changing terms to allow AI training 'could be unfair or deceptive' (FTC).

Frequently asked questions

Do volunteers count toward headcount?

Census counts paid employees only; the programs don't publish a volunteer rule. Expect paid staff to count.

Can a board approve licensing?

The board can authorize the organization's own records; donor and client promises still apply.
